Legal Question in Personal Injury in Indiana
My car was hit while parked in the parking lot of a department store. It was not driveable and had to be towed. The insurance for the guy that hit my car is offering to pay for a rental. However, I only carry PLPD insurance on my car because it is an older car with high miles. The rental car company would require me to buy the comprehensive insurance on the rental car for around $16.00 per day. This guys insurance company is refusing to pick up that extra cost and says it would be an out-of-pocket expense for me. I do not feel that I should pay a penny out-of-pocket since this was entirely their insured's fault. His insurance company is saying it is not an option and it is non-negotioable...they will NOT pay. I have to have a vehicle to get back and forth to work, so what am I supposed to do? I do not have the extra money right now to pay this fee out-of-pocket. Any advice?

1.See if you can uograde your own insurance temporarily.
2. If not, pay the difference to keep your job.
3. Sue in small claims later after your car is back, consulting with an attorney about it before filing anything.
Jay is 100% on point. I am sure an upgrade to your current insurance would be less than $16 a day.
