Legal Question in Personal Injury in Indiana

My cars where hit in an auto accident. I am not insured and i didnt plan on driving the cars until i had insured them. Well one night my cars where hit by a teen motorist who STOLE his mothers car to go on a joy ride and ended up hitting my car. When he hit my car, he hit the car next to it witch is mine too. His mothers insurance is not going to cover the accident because he is not on the insurance. However his mothers insurance did send out an estimater who said that my cars were both totaled and that my vehicles combined are worth $5800.00 what do i do?

I am sorry to hear about the problem. The small claims limit in Indiana is $6000. File suit.

His mother probably agreed to financial responsibility (somebody had to) if he got his license before age 18. If he was under 18 when he damaged the cars, you can also sue his custodial parent for at least part of the loss. Sue all of them for your loss. You can hire a lawyer to go to small claims with you if you would like.

Good luck.
