what to do about my claim
i was a passenger in a car accident.we were hit from the rear. there was a car stoped waiting to turn left, we were stoped waiting for the car to turn.for about 30 secondes. the car in front of us started to turn. as it turned,we were rearended.he was going about 40 miles ahour. the cops were called the young kid amitted he was at fault to the cops and that he was not paying attention,he said he was looking down at the floor board spacing out.i went the eemergency room had neck and back pain. i had exrays done
they said my spine was fine . but i have soft tissue damage in my neck and back. im going to physical therapy 3 times a week and my headaches and back are getting worse.and the doctor said i might have to find a sit down job right now iam a mechanic,i have missed a week of work and if i dont go back i will lose my job.and that is the only income i have.iam not sure if i should settle or get a lawyer?the car i was riding in the driver has full coverage insurance. i got papers from them saying they would cover my medical expense up to 5000.dollars . i want to know if i can take a settlement from both insurance companys or just the person who hit us? this happend on march 28 2oo2

DO NOT settle without consulting at attorney first. I can't stress this enough. The insurance company is out to settle for the least amount possible. Don't let them. At the very least, find out how much coverage there is available to you. Find out if there are any stacking provisions available to you. And whatever you do, DO NOT SETTLE UNTIL YOU ARE HEALED!!! If you rush this for the quick buck, you will regret it later when the injuries are still nagging and you need further treatment. Call if you need further advice. Did the driver who hit you have insurance? He is the one liable not the driver of your car. Your driver's insurance has what is called medpay with $5,000 coverage for medical bills. They are entitled to be reimbursed from any settlement you have with the driver who hit you. I was an insurance lawyer for 14 years and not only know but invented some of their dirty tricks.
I would need to see your medical bills, records, police report and any photos of the vehicles. DO NOT accept anything. DO NOT sign anything. You are an insurance adjusters favorite thing, an unrepresented claimant without a clue of what his case is really worth. You need a lawyer. I can help you on a contingency, no fee until recovery. As you can clearly see from some of the replys, there is no need to rush. You have up to two years before you act. While I would not suggest that you wait that long, begin collecting your information regarding not only your actual injuries, treatmenat and therapy, but also your other damages. This may include lost wages as well as other losses as a result of this incident.
The point is, if you settle now and you find you have a continuing problem you will not be able to reopen the matter. It will be over. This is a matter which requires review of the facts as well as dealing with the insurance companies.
