Legal Question in Personal Injury in Indiana
I feel on private property at a shopping mall and broke my ankle. My insurance paid the medical expenses, and now the company wants to provide me compensation. My ankle will never be its normal size and I still suffer from pain when I walk or try to work out. What is the normal compensation I should receive?

I am sorry to hear of your injury, as it sounds quite serious. There really is no "normal" value for a personal injury such as yours. The factors involve the amount of permanent disability you will suffer, the amount of the medical bills, the amount of disfigurement, the temporary and permanent pain you have suffered and will suffer, lost wages (if any) and other such factors. Please keep in mind that your health insurer will likely want the amounts it paid paid back to them from any settlement you might receive from the shopping center's insurer. Hopefully, with therapy and time, your ankle will get closer to normal and you wont suffer as often and as much. I agree with Larry that there is no norm. There are a lot of factors involved, including the nature of the defect on the property that caused your fall, whether you could have prevented the fall, your age, what you do for a living, your hobbies, etc., the county where the fall took place, and the impact your injuries have had on those and other activities such as standing, running, etc.. the amount of settlement must be substantial enough to make up for past and future medical expenses, disfigurement, permanent disablility,.past and future lost wages, possibly retraining if your job is labor intensive, scarring, and pain and suffering.
