Legal Question in Personal Injury in Indiana
Hello
I need legal advice about something that happened to me last night. I had an accidental overdose of painkillers and had to go to the ER in an ambulance. It was a medical emergency and I didn't bring my wallet. I received good care, and was released a few hours later. Then I called a cab to come pick me up. They refused because I would have to run inside and get my wallet to pay the driver. I called a couple more cabs and they said the same thing. Finally, I got a taxi to say they would pick me up in twenty minutes. About an hour and a half later, they arrived. By this time I was hysterical. I'd worked all day, and then had to go straight to the hospital. It was 4:00AM by then.
The cab driver was East African and as it turned out did not know the city or how addresses work in America, or even how to adhere to a speed limit, change lanes and so forth. I told him to go to 45 N. High School Rd. He went to a house with the address 45, on 45th street. I told him the address at least twenty times, but he just didn't understand. Finally my father called the driver and tried to tell him the same thing. He still didn't understand so my father called the dispatcher, who called the driver and said, and I quote "this guy's giving me a headache." All this took about an hour, and I don't know know how, but about an hour later the driver took me home. By then the fare was up to 50.00. The driver said he FORGAVE ME for giving him the wrong address and said I could pay 25.00. I shouldn't have paid at all but it was 6 in the morning and I'd been up for 24 hours, so i paid and he left.
So in short I ODed on medication, then spent hours trying to get home in that state. I was in pain, scared, sedated, my heart was racing and I was completly confused, dizzy, depressed and tired from the drugs. It may have been the worst thing I've ever gone through.
My question is, can I sue the cab company? They caused me completly unnessicary emotional distress. Outpatients of a hospital and human beings in general should not be treated this way.
I have no money for legal bills. Do I have to let them get away with this because of my lack of funds? Please respond ASAP

If you have a receipt and the name of the driver, you could file a small claims case. You also may be able to file a complaint with whatever agency regulates cab drivers in the city that you live in. Good luck.
