Legal Question in Personal Injury in Indiana
My husband was hurt in a retail store. We were shopping for a stool for using in a hunting blind, the clerk of the store, escorted us to the area and removed a small 3 legged stook from shelf and said "here, try this". When my husband sat down, the stool collapsed and he fell backwards hitting the small of his back on a display that was behind him. The clerk laughed, offered him a different chair to sit in and went on to another customer after to pointing us to the archery department,. This happened on Friday and today he was in enough pain and had tingling sensations in his leg that I made him go to the Emergencey Room. Is the store responsible to pay for this bill? Should we seek a lawyer?

I am sorry to hear about your husband's experience. The store is unlikely to accept responsibility. Over my thirty plus years of experience representing injury victims , I cannot tell you how many times a client was originally told by a retailer or premises owner to send them the medical bills, amnd then nothing happens. You should contact an attorney as soon as possible. The earlier that an attorney is involved,the more likely it is that the initial investigation will be complete and thorough and your rights preserved.
