Legal Question in Personal Injury in Indiana

Personal injury/Statute of limitaitons

Eight years ago, my son then 15, was on a trampoline at a friends house. He knocked out his two front top teeth. Their homeowner's insurance paid for his treatment. Over the past six months, he has had two procedures (bone grafts) on the same area due to bone reabsorption. Should the insurance company pay on these claims too?

They claim that too much time has passed.

Re: Personal injury/Statute of limitaitons

The general statute of limitaions for injuries to minors in Indiana is 2 years after the child has reached 18. Based on the information provided, the insurance company is correct. It is unfortunate that you did not contact an attorney at the time of the occurrence as a settlement or judgment would have incorporated provisions or included amounts for future medical care.
