Legal Question in Personal Injury in Indiana

Hello there,

I was involved in an accident (not at fault) that happened 5 yrs ago in Indiana. Passenger in my car sustained injuries and the medical bills ran up to 20k. The insurance company of the at fault driver gave me the check for my car and then offered up to 10K as imbursements for my passenger. We wanted them to pay all 20K. They didn't agree and we went to court. The court postponed the date for hearing at least about 5 to 6 times over a 2 year period. By the time of the first hearing, the at fault driver died and we were told that he didn't have any estate or anything and the judge closed the case.

My question is: can I now get my insurance company pay for the medical expenses of my passenger or is it too late.?

Unless the passenger is your child, YOU can't get anyone to do anything. Unless the passenger is a minor or otherwise incapacitated, your passenger is probably too late, but the policy language would control. Give a copy of the policy to your passenger and have him/her sit down with an attorney.
