Legal Question in Personal Injury in Indiana

My wife was the cause of an auto accident Feb 2009 which resulted in a medical claim from the other car our insurance company informed us that it possibly could go over our liability limit and that we would be responsible. My question is if I divorce my wife will I still be financially responsible

You are not financially responsible for her negligence simply because the two of you are married. Divorce is unnecessary.
