Legal Question in Real Estate Law in Indiana
I have tried 5 times since April 2009 to refinance my mortgage per my divorce decree. The first broker didn't even send it to an underwrited because he just didn't think it would go thru. The second said my credit score was not high enough, the third said since I made some of my payments by cash and didn't have a paper trail(I had all receipts) they couldn't help, the fourth was National City who while waiting for the 4th court order from my bankructcy trustee with their blessing to refinance decided that in November that the paperwork they sent me in October was not longer any good since they were now PNC, and finally the fifth attempt PNC calls me and tells me "we dropped the ball and didn't get you an FHA number so we can't refinance you". What recourse do I have I am current on my mortage payments and have it in writing from National City, I am current with my Chapter 13 payments thus the 4 court orders to all these mortgage companies advising them it is alright to refinance my mortgage. I DO NOT WANT TO LOSE MY HOME AND SHOULDN'T HAVE TO BECAUSE THESE MORTGAGE EXPERTS DO NOT KNOW THEIR FHA GUIDELINES. PLEASE HELP!

This really is not a legal issue. I suggest that you keep looking for a lender who knows the FHA guidelines. Perhaps you can contact a local HUD housing counselor who has expereince with lenders that know what they are doing. Good luck.
