Legal Question in Real Estate Law in Indiana
We bought a lot within city limits with part of the street as a private drive and we are building a home on it.
Now we find out that we should have signed a street agreement.
The Association has sent us a letter stating that we have to pay for snow removal and maintenance of the street.
The covent we was given says snow removal is included in association dues.
The city says we can't resale the property without a street agreement.
What do we need to do.
Wouldn't the Title company be liable along with the developer and who else?
What should we be entitled to for their mistakes?

You have mentioned several issues. You really need to consult with a real estate attorney and take in all of your paperwork, including the deed, the covenants and then he can review them and tell you your rights and responsibilities under those documents and under the city codes and statutes. He can also tell you whether or not you have a cause of action against anyone and what the chances of prevailing and recovery are.
