Legal Question in Real Estate Law in Indiana
Condominium owner rights
The property management of our condominium will remove snow, but not put salt down to prevent slipping on ice. They don't want to ruin the concrete. They told us in a letter that we are responsible for buying our own playground sand and putting it down ourselves. We pay THEM to take care of this matter, so what if somone falls on ice? Can we sue the management if we get hurt? If an outsider falls, can they sue us personally?

Re: Condominium owner rights
What do the condo assn bylaws say about maintenance? Who selects the management company?
Can you work internally through the assn and get a majority of the owners to support a referendum requiring the use of salt or sand?
If an outsider falls and is injured AND can prove it is policy not to make the walkways safe, the aasn could be liable for damages to an injured party-this might apply to you if the areas at issue are common areas
