co-ownership of real estate
Three individuals,(sister and two brothers),own their mothers farm. How are decisions to be resolved if there is not total agreement between all parties.All parties have equall ownership.This may be that the estate was turned over to the children with the sister being the executor of the estate.

If the property is still property of the estate, then the executor is in control of decisions. If the title is now in all 3 persons as tenants in common or joint tenants with rights of survivorship, then unresolved disputes can only be solved by a petition in court seeking to partition the interests or for instructions as to whether majority rule would apply. Ultimately the only solution will be to sell the property and divide the monies from the sale.
