Legal Question in Real Estate Law in Indiana
Developer added a paragraph in covenants stating he has exclusive rights to any building including additions by a current home owner. I want to add a garage with family room above and asked for a written waiver, which is provided for in the covenants. They declined stating it was not in their best interest, but have give building waivers to other lot owners. Can I do anything?

If you can show that your application was denied unfairly or improperly, you might have grounds to challenge their decision. But this takes a lot of work and proof that someone had the same type of project approved. This type of challenge takes the knowledge of an attorney.
