Legal Question in Real Estate Law in Indiana
Drainage Easement
The 20 year old drainage easement / property grading that was submitted to the city and accepted was never checked. My property along with three others have standing water that should drain if the property was grading properly. The city has send letters to return the property to its ''approved'' levels. The problem is it was never checked and now who has the responsibility to make the property match the drainage requirments that the developer submitted to the city. I know the property never properly matched the plans because the large trees and hills that are on the property. What should I do?
