how can i leagly break a 12 mth lease with not penalty

Unless your landlord has materially breached your lease agreement or some other circumstances have occurred which would allow you to legally terminate the lease, you are liable for the entire lease payments plus the costs and any attorney fees incurred by the landlord. The landlord must try to mitigate his damages by re-leasing the apt. You could sublet if the lease allows and your landlord consents.

Some leases allow early termination without penalty if you have been transferred to another area or simliar circumstances exist.

The only way to "break" your lease legally prior to the expiration date without incurring a penalty is to find a suitable replacement tenant who will take over your unit, pay the rent for the remainder of your period and is acceptable to your landlord.
