evict renter, house is sold

renter had a certain date to buy home, the date has past, I have told renter that I will be looking for a buyer, I have a serious one and I need to know can I give the renter a 60 day notice ? Renter knew I was going to sell home, renter had first chance and now not sure, so I have someone who wants it. What can I do ? I hope you can help me or tell me what agency to call. Thank you.

If your renter's right to purchase the home was spelled out in your lease or a contract, you now need to merely send a letter explaining that the right expired on whatever date that has passed and that you have accepted a purchase offer from another person who has informed you that he no longer intends to rent the property. Then in your letter tell your tenant that the lease will terminate on whatever specific date you select that is at least 30 days down the road. If he fails to move out, then the purchaser has the right to sue to evict the tenant after your closing - unless your purchase agreement requires that you provide the property to him vacant, and in that case if the renter has not voluntarily moved or says he will refuse to move, file your own eviction at least 30 days before your closing upon the theory that the lease has terminated and that he is holding over.
