Legal Question in Real Estate Law in Indiana

Evicting a Single parent with Children

Ive been told that there is a law that states a Landlord cannot evict a Single Parent with children. I have 3 children, 15, 9 & 2. My lease will be up August 2002. I am currently unemployed, and on assistance.

The house i am renting is falling apart, and the Landlord will not do anything to fix it.

Re: Evicting a Single parent with Children

Single parents with children are legally evicted every day. Your status as a single parent is irrelevant. What is relevant is whether you have been paying the rent due, and whether the landlord has been providing the premises you have been living in. It may be possible to assert a defense of breach of the implied warranty of habitiability (and grieve that the landlord has been providing a dwelling open to the elements, rat-infested, or otherwise in breach of code), but that may not be effective if you didn't complain until after your lease expired and you stopped paying rent. Your best solution is to pay the rent. Good luck.
