Legal Question in Real Estate Law in Indiana

Eviction of women with children

My daughter has been sent by mail,an eviction notice of only 30 days, bythe owner of the trailer park where she resides. The reason is independability?? She has been late a couple of times due to lack of support by her ex and does not have the money to move her trailer. Is it legal to evict mothers with children, when they have no where to go?

Re: Eviction of women with children

Indiana law provides for either a landlord or a tenant to terminate the tenancy with a 30 day written notice. A reason is necessary only if there is a written lease requiring a good reason for termination prior to the end of the written lease. You did not indicate that your daughter has a written lease with the trailer park, so I assume she does not. In that case the landlord is perfectly free to give her a 30-day notice. This is a decision the landlord is permitted to make - to decide who he wants to remain a tenant in his trailer park. Your daughter is in an unfortunate situation with undependable child support and minor children, however, there is no law to prevent the landlord from making the decision he has made.
