Legal Question in Real Estate Law in Indiana

There is a fence between us and our neighbors. Our neighbor had already built this fence long before we had moved into our house. The other day our neighbor called and said that the fence was broken and leaning. She told us that we have to pay half of the repair for the fence. We believe that since it is her fence on her property, she should be the one responsible for fixing and paying for the fence. Do we actually have to pay half and half or is our neighbor responsible for the fence?

If it is on her property, its her responsibility absent any ordinaces, housing association ruels or bylaws or written agreements. On the other hand, do you want a broken and leaning fence to look at, not to mention the possible injury risk if she chooses not to repair it? You may wish to consider those non-legal matters.
