Grandfather Clause
Need information regarding the grandfather clause. Friends of mine have been living in their home for 20 years and bought it from a man who also owned an apartment building next door. He also sold the apartments to someone else. 20 years later the new owners have just found out that they needed a new well put in and by doing this found out that the water to the home that my friends live in also is hooked to that well....they didn't know either. I told them that it sounds like maybe this would fall under the Grandfather Clause since its been 20 years. But I'd check since I'm not sure.....Thank - you ahead of time....

I think the more practical approach is for each party to have his own well. I doubt that there is any remedy that would require the apartment property to provide well water for the residence next door, regardless of the knowledge of the various buyers.
