Legal Question in Real Estate Law in Indiana

Homeowners Association

I was wondering what it would take to disband our home owners association. I know I would need the votes, but what happens to all the land that the association owns? Can it be sold off to the city, or can we give it to the city. What kind of motions do I have to make at the meeting and what would the process look like?

Re: Homeowners Association

Thank you for your question. You need to review the associatin bylaws and declarations. There should be provisions for dissolution. There may even be provisons concerning how to convey the property. the city or county may choose to accept or not to accept the property. It is possible that you can sell the property to a private concern. Good luck.
