Legal Question in Real Estate Law in Indiana

Indiana Law

If an adult is living with you (step-son) for a few months without paying rent, utilities, food, etc., can you legally ''kick'' them out of your house without having to give them a 30 days eviction notice in the State of Indiana?

Assuming you do not have an agreement with this freeloader, then the creature is a "tenant at sufferance," and you do not need to give him 30 day notice, or any notice. If he refuses to leave, then you can apply for a writ of eviction from you local small claims court. You must remain peaceable. Violence in his removal can only be done by the constable, sheriff or other police authority when exercising the writ of eviction. Good luck.
