Legal Question in Real Estate Law in Indiana
Indiana Real Estate Disclosure Law
I bought a house 23 months ago. About 8 weeks ago I ended up with 4 plus inches of water in my basement over 1433 sq. ft. The basement is partially finished.
We were told the basement only leaked once during a 5 day power outage during the ice storm of 2005 in Jan. that year.
The sump pump didn't pump due to no electricity. And when the ele. came back on the pump was fried and was replaced. Other than that...the basement never had water. The pervious owner was a Realtor that bought the house and ''filpped'' it. I have found that he used shotty work to finish the basement, using plastic, putting plywood over it, then thin wood bead board type paneling over the finished portion of the basement which is over half of the space.
The basement leaks when there are hard rains, but we are also starting to get mold.
WE are having a quality basement water proofing company who has been around decades and warranties all work to fix our basement. Do we have a case against the former seller?
He did not live in the home but I'm positive he covered up the basement leaking problems.
It especially stings because he is a realtor.

If you can prove that he covered up a severe problem with the house that he knew about, he may be liable to you. Proof of these things can be difficult, however. If you would like to discuss further, please feel free to contact me.
