my step dad just passed, he owned 4 houses he rented out , he had no will, so does my mom automatically take over those houses, is she responsible for the mortgages. they were married 26 yrs. if no will, the step kids cant just take them from her can they? they think they should get the rent money from these houses.. there is $200,000.00 owed on bank loans, whos gets what,there was no life insurance policy the step kids think there was but no.are they due anything

The Indiana Intestate law will control if your stepfather had no will and the properties were only in his name. If that is the case, the houses will be part of the estate and the estate will be responsible for paying the notes, renting the property and possibly liquidating the property. Your mother needs to contact a probate attorney asap
