Legal Question in Real Estate Law in Indiana

Judgments for incomplete Lease

My ex landlord has attempted to collect the remainder of my lease from me over 4 years since I moved out because I joined the military. I told my landlord my intentions when I had confirmed I was joining in the summer of 97. Yet they were adamant in their refusal to break the lease. Now they claim I never notified them and abandoned the property. I know from federal statute that the most they could hold me liable for is one months rent which at that time was about 400.00. They have collected three times that amount from my ex-wife after they got her arrested on her job. My question is can they still attempt to take judgement against me, when it is in clear violation of federal law? Do I have the recourse to sue them if they put anything on my credit report and how long would it take to get it removed?

Re: Judgments for incomplete Lease

If a creditor wrongfully reports a debt to a credit burea, you have several options. You can require the credir bureau to provide documentation for the debt and if you ask in writing, they have 30 days to do so. you can then challenge the posting and try to get it removed

You can also sue the landlord for slander of your credit reputationand any othet violations of federal law.
