Legal Question in Real Estate Law in Indiana

Landlord Wants to Terminate Lease Early

My landlord lives out of state and called today saying that he planned to move back and wants to terminate our lease...three months into a one year lease. Can he force us to move out if we have not violated the lease in any way?

Re: Landlord Wants to Terminate Lease Early

If you have a lease for a period of time - like a year - signed by the owner of the property or his authorized agent, then you are entitled to possession of the premises for the entire year. You might consider negotiating something to make it worth your while to leave early - cash to include cost of new security deposits plus whatever would be fair to compensate you for the aggravation of moving early, plus something on the moving expenses. If you do decide to move, make sure you have his written agreement so you can get your security deposits back.
