Legal Question in Real Estate Law in Indiana

Liability

My 2 brothers and I own 37 acres of wooded land. They are putting up a cabin for hunting and parties. I do not want anything to do with this and am concerned if an accident were to occur what kind of liabilty would I incur? I would like to have an aggrement between the three of us stating that in the case of injury or accident, I am not responsible. If the agreement would be signed by all three parties and notarized, would the document hold up in court? My brothers are not able to buy my portion of the property.

Re: Liability

The agreement would not hold up against third parties. Your best bet is to make sure that there is plenty of insurance!

An alternative is to subdivide the acearage so that only the two brothers own that part where there is hunting and parites. You should put up a no hunting and no trespassing sign on the part that you keep.
