Legal Question in Real Estate Law in Indiana

We live in a neighborhood that did not have a homeowners association when we purchased our home. Now they have decided to form one. We operate a childcare from our home and the covenants and restrictions forbid any business activity. What are our rights and can we opt not to join the homeowners association?

You cannot be forced to join a homeowners association or have their rules forced upon you unless your deed contained covenants and provisions that allowed for a homeowners association.
