Legal Question in Real Estate Law in Indiana

I have lived on my property since 1996. In 2006 my property was surveyed. Next to my yard is a field that has a fence and the fence sits just inside my property line. The fence is rusted and old. It is hard to control the weeds that grow in the field and into my yard. The owner of the field has done nothing since I have moved in to take care of the weeds or the fence. My dog got caught in loose barbed wife from the fence and was hurt. Last year I got a very bad case of poison ivy when I was trying to cut down weeds in the field. The poison ivy on the fence has gotten worse. Since the fense is on my property can I cut down the fence or do I need to get permission from the land owner who farms the field?

If the fence is on your property, you can cut it down. You may want to send a letter to the field owner asking himn ot remedy the situation and advising that you will if he does not.
