Legal Question in Real Estate Law in Indiana
My mother owns her home and had a privacy fence installed 15 years ago. We just recently found out that part of the fence is 8" on her neighbors property, which is a empty wooded lot, we are thinking about putting her house up for sale, do we need to relocate the fence or would it be part of the easement?

It's not an easement. If you put the house up for sale you would have to inform any buyer of the problem. I would recommend relocating the fence to the proper line and then the problem is solved.
