My neaghbors tree is damageing my property the tree is growing under my fence and pulling up my concreate walkway can i sur for damages the ower refused to cut the tree.

You have an obligation to mitigate your damages, in other words you may cut those parts of the tree that are on your property and sue the neighbor for damages and the costs related to removing those parts on your property. I suggest that you discuss the situation with your neighbor since the roots will grow back. Perhaps he will remove the tree.
