Legal Question in Real Estate Law in Indiana

Hello, my offer to buy a house was accepted , during the inspection I found water issues and mold in the crawling space while one item in my contract ask if the seller knows about any hazard condition it includes " mold" along with other things and the seller has said " No" however the inspector found significant mold presence in the crawl space and the seller was aware of it as after he accepted my offer he gave me a inspection report that was done 2 months before selling his house. I want to back out from the contract , my agent said the seller can charge me ( pay fine) if I back out as I was buying the property with cash. You need to put your contract rejection in writing and provide a copy of the inspector's report and photos. If he doesn't return your money, you can go to small claims court.
