Legal Question in Real Estate Law in Indiana

property boundry lines

My neighbor built a dirt wall and used railroad ties to brace it on his property and I had my property surveyed and discovered the wall is on my property.

Can I legally make him move it?

I ask him to, but he refuses to.

Any advice would be greatly appreciated. I live in Dekalb county.

Your neighbor has no right to built on your property. If he does not move it you could remove the portion that is on your land - being sure not to undermine what is left on his property. You would also have a right to sue him to move his dirt wall. He has a right to build the wall, just not build it partially on your property.
