Legal Question in Real Estate Law in Indiana

Property joining a state owned waterway

I own a farm that has a state-owned creek running through it. People park at the bridge (that runs over it, on the road), walk down on my property to fish/swim. Do I have the right to ask them to leave? Once they are on the bank, aren't they on my property? Adjoining property owners try to access the creek further down from their property riding atvs and walking it also. Signs are posted, but doesn't seem to matter. Concerned about privacy and liability. Thanks for your help.

Re: Property joining a state owned waterway

There is little question in my mind that you have the right to keep people off your property, including along the bank (whether you may prevent boaters would be a separate question). How far you are willing to go to keep these activities from happening is likely a practical and/or economic issue. If you would like to consult us regarding a legal strategy, please feel free to call.
