Legal Question in Real Estate Law in Indiana

I recently bought a house in Indiana and have discovered that the finished basement leaks and there is some mold. On the seller disclosure, he checked that the basement does not leak. It's pretty obvious that these leaks are not new. Right now I am gutting the basement in order to have it water proofed. Can the previous owner be held responsible for the costs of fixing this issue?
