Legal Question in Real Estate Law in Indiana

I've recently hired a title company to research and clear a property of all liens and delinquent taxes and to issue a warranty deed at closing. I have evidence to prove they have failed do carry this through. The funds I have provided for purchasing the property and closing are being held in escrow. I wish to have my funds returned. The seller has refused to sign the release of earnest money. What steps must I take to have my money refunded?

Sue the seller; it appears that your beef is with the seller, who has failed to provide clear title. Hire an attorney to do this.
