Legal Question in Real Estate Law in Indiana

I am a renter in Indiana. I have a lease to own contract, I have had it for 8 months into a 2-year term. I have been late on some payments and am trying to get caught up. 30 days ago I received an eviction notice saying that I had to become current by 30 days (by 12/9/09) or move out by 12/9/09. Right now I still owe $400 for an $800/month payment for December and some late fees, which I planned on paying on the 18th. Today he e-mailed me that he is being foreclosed on and I have until the end of the month to get out. What is the procedure for foreclosures? Do I really have to be out by Jan. 1? Or legally do I have more time? Can he evict me now for being 9 days late on the current month? I am a single mom and have nowhere else to go.

He has to follow all procedures in order to evict you and that means proper notice, service and a hearing. I doubt that he can accomplish all of that by January 1, 2009. However, if I was you, I would start looking for another place to live. Especially, since the place is in foreclosure. You should confirm that the place is in foreclosure by going to the courthouse or looking online.
