What are my rights as a landlord?
I have a tennant living in my home who refuses to sign a vacate agreement I've drawn up. She states she can't afford a place of her own and she doesn't know where she'll go. Our original rental agreement states either one of us must give one calendar's month notice if either of us find the living arrangements unacceptable and that she owes rent during her final calendar month here. I gave her notice 8/22/02 and informed her she could stay till 10/6/02. What can I legally do if she refuses to leave and how do I go about it?

Did you give her notice in writing? if so and her time is up, you can go directly to small claims court and file for eviction. The court will notify her and set a hearing, usually within a few weeks. At the hearing, prove you own the house, she is a tenant, and you gave her 30 days notice. the court will probably give her 10 days to get out. After that, the sheriff will asssist you in getting her out. Hopefully it wont go that far
