Shared maintainance of driveway

I currently have a shared driveway with my neighbor. When we bought the land, we both signed a legal agreement that we would share the cost of maintainance of the driveway. He has yet to build his house on his property and therefore, is very adverse to giving his half of the cost to finish it. I have lived here for 3 years now and have been very patient. If he continues to refuse to give his half of the cost, can I force him to pay me my half of the driveway and build my own? Or, can I force him to build his own? And, who enforces such agreements?

Without seeing the agreement, your question is difficult to answer. However, unless the agreement states otherwsie, you could sue him in small claims court for 1/2 of the maintenance costs assuming that there are less than $6000 in such costs. Good luck.
