The type of court depends upon the amount involved. If you are under a certain amount, you can use city court or town court or small claims court. Over a certain amount, and you have to use circuit court or superior court, for which you should have a lawyer. Even if a tenant pays rent, the tenant cannot damage the property. You can sue to evict if the tenant is causing damage. But yo should document the damages with photographs and you should have an attorney to assist you with the proper procedures.
