Can I sue for remainder of lease?

In June of last year I unexpectidly got married and I leased my house to a co-worker with 1st option to buy any time during or at the end of the lease. He leased the house knowing that we couldn't keep up with both house payments. Needless to say he didn't keep up with the payments and wrote us 2 checks which both bounced so my husband and I sent him a 30 day eviction notice and he had a past due amount of $600.00 and I was left with an empty house and $838.51 house payments. We put the house on the market hoping that it would sell before winter which it didn't so my niece is now living in the house for $500.00 a month which leaves me paying the rest of the monthly payment. Can I sue him for the remainder of the contract and the monthly difference that I am now having to pay or am I going to have to take the loss? The contract ran from July 2002 to July 2003 with him only paying for a full month and $200.00 of the second month.

You can sue for damages for the remainder of the lease terms, plus the cost of reletting, Minus what you received from the new tenant. Remember getting a judgement is the easy part-collecting on it is tougher. Good luck
