Legal Question in Real Estate Law in Indiana

My wife and I purchased a house in 20007. At the closing we should have been told to file a homested exemption,by the title company, to reduce the property taxes and now I am being taxed $4,718.00 more than if I had filed the exemption. What is my next step?

That is a major reason why there should always be a lawyer at a closing for a buyer. A lawyer usually charges between $300 and $500 for a closing, and would easily have saved you that with the homestead. The title company had no obligation to advise you to file for homestead, although many do.

A good real estate professional would have, but again, not his or her responsibility. You need to contact the county to see if there is any procedure available to you. In the meantime, be sure to file so that next years taxes are appropriate.
