Legal Question in Sexual Harassment in Indiana
wrongful termination
A friend of mine (female) was terminated. She work for a company that was sold and the new one rehired the employees. She was in a management position and the V.P. made sexual advancements towards her. She complained to her supervisor and the next working day she was told that her services were no longer needed. Indiana is an employment at-will state and she was still in the 90 probation period for the new company, therefore she was not given a reason. I believe that she has a case for wrongful termination and sexual harassment.

Re: wrongful termination
Retaliation - almost certainly. Sexual harassment - I need more detail about the interaction between your friend and her boss. Depending on the size of the employer, your friend could be entitled to substantial damages. One of the largest verdicts I have obtained in federal court came on a sexual harassment retaliation case. Please feel free to contact me for further information.
Re: wrongful termination
Need to have more information but from what you've said, it appears there was a violation of federal law which prohibits such actions on the part of an employer.
Sexual harrassment is typically one of the areas in which the courts have been more sensitive in the past several years.
Strongly suggest you have your friend contact a lawyer in her area to consider filing an action. She needs to contact an attorney who is experienced in doing these kinds of cases. Also, there are statutory deadlines for filing an action, so she should not delay or she could lose her rights.
If she's in this area, have her contact me by phone or email.
Re: wrongful termination
From the facts that you provided, it sounds like your friend has a claim for sexual harassment and retaliation. However, I would need more information regarding the size of the employer and some of the circumstances of your friend's complaint. If possible, I would encourage your friend to contact an attorney for a more formal consultation as it appears that her rights have been violated. If you wish, I may be contacted at the number below or by email at [email protected].
