Legal Question in Traffic Law in Indiana
In March 2008 my son age 23 was arrested for owi. He was put o house arrest, fined, license suspended for 180 days, and had to take a drug and alcohol class as well as being on probation for one year . July 2009 he was stopped because he only had one working tail light. The officer asked him to take a breath alcohol test and he refused. He spent the night in jail and posted bond the next morning and was released. The next day the prosecutor put a warrent out for his arrest because of his prior conviction . Police showed up at his apartment but he wasn't home. When he heard about it he went to the police station and turned himself in. They arrested him for a class D felony OWI and let him go on his own recognisence. What do you think his punishement will be. Is there any possiblity that he could avoid jail if he went on an antabuse program?
