Legal Question in Wills and Trusts in Indiana
i am the new acting pastor of a church and it was just brought to my attention that the treasurer (whom is a elderly woman that has been a member for 69 yrs) gave the recently deceased former pastor $16,000 to put in the churches bank account for safe keeping (this is what was writen on the check). this transpired in aug. of 2006 and by may of 2007 it was withdrawn with no traces of it besides $2,000 that was transfered to the churches general fund. is the church obligated to repay this money?

Tough question. Too many facts that are unknown here to clearly answer the question. When you say "by may of 2007 it was withdrawn" it is not clear from where it was withdrawn. From the pastor's account? From the church's account? Also, is there some kind of Estate claim being made? Lot of unknowns here. Far too many to really answer the question. Best thing to do is contact a local attorney and get some guidance, especially if any kind of demand is being made on the church.
