Legal Question in Wills and Trusts in Indiana

Can attorney charge extra for estate settling other than court ordered amount?

Our Attorney is trying to charge us $10,000 for total of rate per hour he worked on estate which was worth $27,000. We lost the estate to the soon to be exwife, even though there was a will. The court awarded the attorney $1600 in fees and he says we still owe him the balance of 10,000. We never signed any papers to this effect. Is this allowed? Please help us by email me with any info you can come up with in the law books or the name of someone higher up that can settle this problem of injustice. thank you, Judy Scott

From the facts you gave, it does not seem that there was a written contract. The question then becomes did he perform $10,000.00 worth of work? If he did, then you can be liable for the work that he did perform at your request. You might want to contact the Disciplinary Commission of the Indiana Supreme Court. It can be found online at http://in.gov.
