Legal Question in Wills and Trusts in Indiana

Changing or canceling a Last Will and Testament.

I am recently married and discovered my new wife had a "Will" made up in 1991. It still states that her ex-husband is benefactor. It was drafted by a lawyer who is no longer around. We do not know if it was recorded or not. How or what do we have to do to cancel this will? Does a new one over-ride the old one? Should he (the ex-husband) be notified that he is no longer on her will?

Re: Changing or canceling a Last Will and Testament.

If properly drafted, a new Will will supersede and revoke any prior Wills. Follow the advice of your new estate planning attorney on this matter.
