Dad and Mom

mother dies father wants estate settled, bank was exec. but now I have poa over all of Dads assets,can i enforce settlement of mothers estate so it goes to father? Can bank holding morgage on property put hold on estate?

Assuming your power of attorney is broad or general enough to encompass all of the statutory provisions, you would have authority to deal with the executor of the estate in order to settle the same. A bank which acts both as a creditor and a personal representtive may well have an inherent conflict of interest. You should talk to both the person at the bank who is the personal representative contact as well as the attorney for the estate about the issues.
