My father-in-law died recently. Our house is in his name, and we pay the mortgage. Essentially he was our land lord. We have bad credit so he did this for us (bankruptcy less than 1 year ago). We can't get approved for the loan. Will we have to move? He had no will, but some money from his retirement in his checking acct. As far as debt he had our house, his van, and one small credit card. Will his children have to pay those debts off before splitting what is left of his account?

An estate will need to be opened and I suggest you talk to an attorney as soon as possible. With the house being in father-in-law's name, no one owns the house right now.
